Who is Responsible?

Town of Brookhaven – Responsibilities

  • Streets / Roadways: Maintenance, snow removal
  • Curbs & Curbing: Maintenance and repair
  • Aprons: Maintenance and repair
  • Trees: Maintenance of trees within 6 feet of the curb
  • Report Damage To: Superintendent of Highways – (631) 451-9200

The Association (HOA) – Responsibilities

Grounds & Landscaping

  • Common area lawn care (spring/fall cleanup, weekly mowing, trimming, edging)
  • Lawn chemical treatments (fertilization, weed/crabgrass control, liming)
  • Planting beds adjacent to homes (unless modified by homeowner)
  • Maintenance of trees in common areas
  • Irrigation system (maintenance & service requests)
  • Snow removal in clubhouse area (not roadways, driveways, or walkways)
  • Sidewalks Maintenance

Sewer Lines

  • Breakage/blockage from common area tree roots or structural defects (e.g., bad pitch) – with professional confirmation and approval
  • Does not cover blockages from improper use (e.g., diapers, excessive paper)

Parking

  • Maintenance and resealing of assigned parking spaces at clubhouse

Concrete Walks / Driveways

  • Crack repair (>¼ inch) and replacement for liability
  • Driveway maintenance/sealing on a rotation basis
  • Please Note: Damage due to oil, grease, or auto work billed to homeowner

Pest Control

  • Wasps/bees removal only on common grounds

Homeowner/Resident – Responsibilities

Grounds & Landscaping

  • Snow removal from personal driveways and walkways
  • Maintenance of modified or custom planting beds
  • Custom pruning of shrubs
  • Maintenance and removal of trees within homeowner plot
  • No planting on common grounds

Exterior Home Components

  • Chimneys, caps, flashing, skylights
  • Gutters and leaders
  • Fascia repair
  • Sheds (attached – maintain/replace; detached – pre-approval + full responsibility)
  • Roof replacement (all types)
  • Siding
  • Exterior garage doors/windows – maintenance and painting (specific color required)
  • Foundations
  • Power washing (HOA doesn't provide; homeowners responsible for appearance)
  • Fire alarms
  • Buried oil tanks (maintenance, inspection, replacement; must follow Town & EPA guidelines)
  • Attic vent covers (side of homes)

Shared Structures

  • Common fences/walls/gates – joint maintenance with neighbor or full homeowner responsibility

Insurance

  • Must obtain HO3 policy (NOT condo insurance)
  • Responsible for insurable events (storms, fire, etc.), including tree removal on homeowner plot

Repairs to Home

  • All interior repairs

Notes / Special Instructions

  • All major repairs must conform to HOA architectural standards
  • Permission must be obtained from HOA for exterior changes (e.g., vinyl siding, fences, etc.)
